The Massachusetts intrastate rule

Federal USDOT registration depends on the vehicle and operation. The rows below show what Massachusetts requires for carriers operating inside the state. The Massachusetts line is 10,001 pounds gross vehicle weight rating or gross combination weight rating, the same line the federal rule uses for interstate carriers. 540 CMR 2.22 also reaches every vehicle designed to carry more than 15 passengers including the driver, and every vehicle of any weight carrying hazardous materials in a quantity that requires placards. The RMV states the requirement turns on this definition regardless of how the vehicle is registered with the Registry, so a truck on passenger or light commercial plates is still covered when it rates 10,001 pounds or more.

Massachusetts requires a USDOT number for purely intrastate operation. The RMV regulatory bulletin dated August 9, 2018 put the rule in force on September 1, 2018, with strict enforcement from January 1, 2019, and 540 CMR 2.22 requires every subject intrastate vehicle to be permanently marked with the number. Exempt when operated solely within Massachusetts: vehicles owned and operated by the Commonwealth or a political subdivision; municipal or state-agency hazmat vehicles (a private contractor hauling for them is not exempt); municipal transit-type buses; MBTA and Regional Transit Authority buses; school buses and school pupil transport vehicles carrying students locally; and professional driving school vehicles used for Class A, B or C CDL skills training.

Every subject intrastate vehicle must be permanently marked with the USDOT number in a manner conforming to 49 CFR 390.21: the legal or single trade name and the number preceded by USDOT, on both sides of the power unit, in letters that contrast sharply with the background and are legible from 50 feet in daylight while the vehicle is stationary. Separately, 540 CMR 2.22 requires the owner of every motor truck used for hire with a load capacity between 2,000 and 10,000 pounds to show the owner's name on both sides, in permanent contrasting letters legible from 50 feet; a truck under a lease of more than 30 days may show the owner or the lessee. Farm trucks carrying the farmer's own products, machinery or supplies within 150 air miles of the farm, and not used as a common or contract carrier, are exempt from the owner-name marking. Failing to obtain and display a USDOT number can bring a civil fine and an out-of-service order until the company obtains one; the penalty for a 540 CMR 2.22 violation is set by M.G.L. c. 90, s. 20.

Massachusetts issues no carrier number to general freight carriers; the intrastate identifier is the USDOT number from FMCSA. The only Massachusetts-issued carrier number is the DPU certificate number for household goods movers, which M.G.L. c. 159B, s. 16B requires in every advertisement in the form MDPU NO. The DPU application pages checked do not say whether a USDOT number must exist before the DPU grants that certificate, so usdot_prerequisite is blank rather than a guess; the 540 CMR 2.22 duty applies to a mover's trucks of 10,001 pounds or more either way.

There is no Massachusetts enrollment for the intrastate USDOT number: the RMV sends every carrier to FMCSA and takes no application of its own. General freight carriers file nothing further with the state for the number. The state credential that does exist sits with the Department of Public Utilities, Transportation Oversight Division, which grants operating authority to household goods movers, involuntary tow companies and intrastate passenger carriers after a monthly public hearing, with online applications paid through Catalis; our Massachusetts intrastate authority page covers that process and its fees.

Whether a company operates intrastate or interstate, the RMV sends it to the FMCSA website for the number. The number carries the federal biennial update duty under 49 CFR 390.19, which the RMV IRP User Manual restates for apportioned carriers.
